1. About these terms
These terms apply to anyone who visits or uses evidtrail.com (the "site"). The site is run by Protomated, operating in Nigeria as [registered company name, RC number], [registered address] ("Evidtrail", "we", "us"). By using the site you accept these terms.
They cover the website only. If you become a client or a partner, your client contract or partner agreement governs the Evidtrail service, and it takes priority over these terms where the two differ.
2. Using the site
You may use the site to learn about Evidtrail, book a demo or apply to our partner programme. You agree not to:
- send false, misleading or someone else's details through our forms;
- try to get into parts of the site or our systems that are not meant for you, or test their security without our written permission;
- overload, scrape or automate requests to the site, or interfere with how it works for others;
- use the site or its content to mislead voters, to impersonate Evidtrail, or for anything unlawful.
3. No legal advice
Content on the site, including guides, examples and the sample evidence pack, is general information about how Evidtrail works. It is not legal advice. Talk to your own lawyer about your campaign, your evidence and any petition.
Examples on the site use made-up data. They do not describe any real polling unit, candidate or party.
4. Claims about evidence
Evidtrail is built to produce evidence that is admissible; the tribunal decides. We describe how evidence is captured, sealed and kept, but we do not promise that any tribunal or court will admit or rely on a particular item, or that a petition will succeed. That depends on the law, the facts and how the case is run.
5. Intellectual property
The site's text, design, graphics, software and the Evidtrail name and seal mark belong to us or our licensors. You may view and print pages, and share the sample evidence pack with your lawyers, for your own use in deciding whether to work with us. You may not copy, adapt or republish site content for any other purpose without our written permission.
6. Links to other sites
The site links to other websites, such as INEC's IReV portal and the Nigeria Data Protection Commission. We don't control them and aren't responsible for their content or how they handle your data.
7. Liability
We work to keep the site accurate and available, but we provide it "as is" and may change, suspend or withdraw it at any time. To the extent the law allows, we are not liable for any loss arising from your use of the site or from relying on its content, including lost profits, lost data or indirect loss.
Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud. Our liability for the Evidtrail service is set out in the client contract, not here.
8. Privacy
Our privacy notice explains how we use personal data you give us through the site, including demo and partner requests.
9. Changes to these terms
We may update these terms. The version and date at the top show when they last changed. If you keep using the site after a change, the new terms apply.
10. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria. The courts of [venue, e.g. the Federal Capital Territory, Abuja] have jurisdiction over any dispute about them.
